Terms and Conditions

1. Acceptance of Terms

By creating an account, subscribing to a plan, or using any of our tools, you confirm that you have read, understood, and agree to these Terms and Conditions. We may update these terms from time to time, and continued use of the service constitutes acceptance of any changes.

2. Description of Service

Imagy provides browser-based image processing tools (compression, conversion, cropping, resizing, and more) as well as AI-powered image generation and editing features. Most image processing happens directly in your browser. AI features rely on third-party APIs and cloud infrastructure.

3. Accounts

Some features require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must provide accurate information and keep it up to date. We reserve the right to suspend or terminate accounts that violate these terms.

4. Subscriptions and Billing

All payments are final and non-refundable. We do not offer refunds for subscription fees, partial billing periods, or unused credits.

You may cancel your subscription at any time through your account settings dashboard or by contacting us at support@imagy.app. Cancellation takes effect at the end of the current billing period — you will retain access to Pro features until then.

Subscriptions automatically renew at the end of each billing cycle (monthly or yearly) unless canceled beforehand. Prices may change with reasonable notice.

5. AI Credits

Pro subscribers receive a monthly or yearly allocation of AI credits depending on their billing plan. Credits are used to generate or edit images using AI models.

Monthly credits reset with each billing cycle. Unused credits do not roll over to the next period.

Credits are non-transferable, have no cash value, and cannot be exchanged or sold.

We do not guarantee that any specific AI model or feature will remain available. Models may be added, removed, or modified at any time.

If an AI generation fails due to a technical error on our end, credits are automatically refunded. No manual credit refunds are provided.

6. No Warranties and Limitation of Liability

Imagy is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. We rely on third-party services and infrastructure (including AI model providers, cloud storage, and content delivery networks) and cannot guarantee uninterrupted service, error-free processing, or specific outcomes.

To the maximum extent permitted by law, Imagy and its operators shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of, or inability to use, the service. This includes but is not limited to loss of data, loss of revenue, or service interruptions.

Image processing and AI generation involve multiple technical components. While we strive for reliability, we cannot guarantee that every operation will succeed or produce the expected result.

7. Intellectual Property

You retain ownership of any images you upload to or create with Imagy. By using our service, you grant us a limited license to process your content solely for the purpose of providing the service.

The Imagy platform, including its design, code, features, and branding, is the intellectual property of its operators. You may not copy, modify, or redistribute any part of the platform.

Images generated using AI features are yours to use. However, AI-generated content may be subject to the terms of the underlying AI model providers.

8. Acceptable Use

You agree not to use Imagy to process, generate, or distribute content that is illegal, harmful, defamatory, or infringes on the rights of others. We reserve the right to remove content and suspend accounts that violate this policy without prior notice.

9. Privacy

Your use of Imagy is also governed by our Privacy Policy. Most image processing happens entirely in your browser and your files are not uploaded to our servers unless you use cloud-based features such as AI generation or storage.

10. Termination

We may suspend or terminate your access to the service at any time for violation of these terms or for any other reason at our discretion. Upon termination, your right to use the service ceases immediately. Any stored data may be deleted after a reasonable period.

11. Changes to Terms

We reserve the right to modify these Terms and Conditions at any time. Material changes will be communicated through the service or via email. Your continued use after changes constitutes acceptance of the updated terms.

12. Governing Law

These terms are governed by and construed in accordance with the laws of Switzerland. Any disputes shall be subject to the exclusive jurisdiction of the courts at the registered seat of above the fold GmbH in Switzerland.
